1. About These Terms of Service
These Terms of Service ("Terms") govern your access to and use of thesellerindex.com and any data products or services provided by The Sellers Index ("we", "us", "our"). By accessing our website or purchasing a data product, you agree to these Terms. If you are using our services on behalf of a business, you confirm you have authority to bind that business.
These Terms apply alongside our Privacy Policy and GDPR B2B data compliance guidance.
2. Data Licensing
A data licence from The Sellers Index is non-exclusive and non-transferable — your rights are limited to internal use within the purchasing entity. See our Amazon seller data pricing page for field and configuration details.
2.1 Licence grant
When you purchase a dataset from The Sellers Index, we grant you a non-exclusive, non-transferable licence to use that data for your own internal commercial purposes, subject to these Terms and applicable data protection law.
2.2 Permitted use
You may use Sellers Index data to:
- Contact Amazon sellers for legitimate B2B commercial outreach (sales, compliance services, logistics, etc.)
- Conduct market research and competitive analysis
- Build prospecting lists for your own internal use
- Filter and segment records by the 11 enriched fields — including VAT status, base country, and category
2.3 Prohibited use
You may not:
- Resell, redistribute, or sub-license the data to any third party
- Use the data in a way that violates applicable data protection laws (including GDPR and UK GDPR)
- Use the data for spam, harassment, or unsolicited bulk messaging
- Combine the data with other datasets to create derivative products for resale
- Scrape, copy, or extract additional data from our platform beyond your purchased dataset
Breach of the prohibited-use clause constitutes a material breach of these Terms and will result in immediate licence termination.
3. Data Accuracy
Every dataset passes multi-point verification before dispatch: SMTP email validation, Companies House and Handelsregister checks, INPI registry verification, and VIES VAT cross-referencing. We use multi-point verification to maximise email deliverability. If your dataset has a material quality issue with email addresses within 30 days of delivery, contact us at [email protected] with your order reference and we will provide credit replacement at no charge. 4. Payment and Refund Terms
All prices are in GBP unless stated otherwise. Payment is due before delivery of data products. We accept payment via credit card and bank transfer.
Due to the digital nature of our products, we do not offer refunds once a dataset has been downloaded or delivered. If you believe there is a material quality issue, contact us within 30 days of delivery under the terms of clause 3.
4.1 Pricing and chargebacks
The price at checkout is the total payable, inclusive of applicable taxes. Contact [email protected] before initiating a chargeback — most disputes resolve within 5 business days.
5. Intellectual Property
All content on thesellerindex.com — text, design, code, graphics, and database compilation — is owned by or licensed to The Sellers Index. Our database structure, verification methodology, and enrichment layer are proprietary; reverse engineering or creating competing products from our output is prohibited. You retain ownership of your own business data.
6. Acceptable Use Policy
You agree not to use our services to violate any applicable law, infringe third-party intellectual property rights, transmit harmful or fraudulent content, attempt unauthorised access to our systems, or interfere with service availability. We reserve the right to suspend or terminate access for any user who violates these Terms.
6.1 B2B outreach compliance
All outreach using Sellers Index data must comply with PECR and UK GDPR. For EU recipients, the ePrivacy Directive also applies. The ICO's direct marketing guidance provides a practical B2B framework. The sender — not The Sellers Index — bears responsibility for compliance in each recipient's jurisdiction.
7. Limitation of Liability Under These Terms of Service
To the maximum extent permitted by law, The Sellers Index shall not be liable for indirect, consequential, incidental, or special damages; loss of profit, revenue, or business opportunity; loss arising from use of our data contrary to these Terms or applicable law; or data changes after delivery as seller information changes. Our total liability for any claim arising from these Terms of Service shall not exceed the amount you paid for the relevant data product in the 90 days prior to the claim. This liability cap reflects the B2B nature of the service and is consistent with standard practice for data licensing agreements under English law. Before raising a formal dispute, we encourage customers to contact us directly — most issues are resolved within 5 business days. Nothing in these Terms excludes liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Our website may contain links to third-party websites. We are not responsible for their content, privacy practices, or availability. Links do not imply endorsement.
9. Disclaimer
Our website and data products are provided "as is" without warranties of any kind, express or implied, beyond those expressly stated in these Terms. We do not warrant that our services will be uninterrupted or error-free.
10. Changes to These Terms of Service
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms. Material changes will be notified to active customers by email at least 14 days in advance. Check the "Last updated" date at the top of this page to confirm whether the version you read has changed.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales. Can I share the dataset with colleagues inside my company?
Yes — the licence covers internal use within the purchasing organisation. Colleagues with a legitimate business need may access it. Contractors, affiliates, or separate legal entities require a separate licence.
What happens if there is a data quality issue?
Contact [email protected] within 30 days of delivery with your order reference. We will review the issue and, where verified, provide credit replacement at no charge. See clause 3 for the full data accuracy terms.
Can I resell or redistribute the data?
No. Resale, redistribution, and sub-licensing are prohibited under clause 2.3. Building a derivative product for sale constitutes a material breach and results in immediate licence termination.
Is there a cooling-off period or right to cancel?
Because our products are digital goods delivered immediately upon payment, the 14-day cooling-off right under the Consumer Contracts Regulations 2013 does not apply once download has begun. Raise quality disputes within 30 days under the data accuracy terms in clause 3.
How do the terms of service interact with the Privacy Policy?
